2. INFORMATION ABOUT THESE TERMS
2.1 This page sets out the terms (“Terms”) on which we sell any of the books listed on our website (“Books”) to you.
2.2 These Terms and our Website Terms of Use, Privacy Policy and Cookie Policy govern our relationship with you (we will refer to you in these Terms as “you” or “your”) and apply to your use of our website and any order placed by you for the sale of Books to you.
2.3 Please read these Terms carefully before using our website. By using our website, you agree to be bound by these Terms.
2.4 Every time you wish to order Books, please check these Terms as we may have made changes to them since your last order and the Terms in force at the date of each order will apply.
3. PLACING AN ORDER
3.1 How to place an order. You may place an order for Books by completing the online ordering process on our website.
3.2 Why we may reject your order. We may contact you to say that we do not accept your order for any reason (such as where the Books are unavailable or there has been a mistake on the pricing or description of the Books).
3.3 When we may cancel the order. If we are unable to perform the whole or part of an order due to any cause or event beyond our reasonable control we may, at our option, by notice in writing to you, cancel or suspend the order in whole or in part without liability and without prejudice to our rights to receive payment of the price for all Books previously delivered. For further details of what constitutes Force Majeure please see Clause 9.
4. PRICE
4.1 The price of a Book will be as quoted on our website. Prices for our Books may change from time to time, but changes will not affect any order which you have made and we have acknowledged prior to the date of change.
4.2 The stated price of a Book does not include Delivery Charges. Our delivery charges will be as quoted on our website.
5. PAYMENT
5.1 Payment may be made by credit/debit card. We accept payment by Visa, MasterCard, Switch, Maestro and Delta or Paypal. Payment will be debited from your account before despatch of the Books to you.
5.2 Payment may also be made by Direct Bank transfer to our account. Your order will not be shipped until your payment has cleared in our account.
5.3 All Book prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion, if necessary.
6. DELIVERY
6.1 All Books are shipped by courier, with a signature required upon delivery, so you cannot use a PO Box as a delivery address.
6.2 The delivery charges will be as itemised on our website.
6.3 When ordering Books for delivery overseas you may be subject to import duties and taxes, which are levied once the Books reach the specified destination. Any additional charges for delivering the Books to the specified delivery address (such as import duties and customs clearances) must be borne by you.
6.4 All estimated dates of delivery are approximate only and, while we will endeavour to avoid delay, we will not be liable to you for any loss or damage arising from delay in delivery.
6.5 The Books will be at your risk from the time of delivery.
6.6 If you receive the wrong Books or Books are damaged in transit, you must contact us within 28 calendar days and confirm to us what has happened. Please see Clause 7 for more information on your right of return, refund and cancellation.
7. RIGHT OF RETURN, REFUND AND CANCELLATION
7.1 You may be able to cancel your order with us. Your rights will depend on whether there is anything wrong with what you have bought and when you decide to cancel the order:
7.1.1 If what you have bought is faulty or misdescribed you may have a legal right to cancel the order (or to get the Books replaced or to get some or all of your money back). Please see clause 8.2 for further information;
7.1.2 If you have just changed your mind about the Books. You may be able to get a refund if you are within the cooling-off period, but this may be subject to deductions and you will have to pay the costs of return of the Books. Please see clause 8.3 for further information.
7.2 If there is a problem with the Books. If you wish to exercise your legal rights because the Books you have bought are faulty or mis-described then please contact us immediately – see our contact page for full details on how to contact us.
7.3 Exercising your right to change your mind. You have the right to return purchased Books for a refund within a cooling-off period of 14 days of you receiving the Books but this right shall not apply to books purchased by you and produced by us to your specifications or which are clearly personalised.
7.4 How to notify us. To exercise the right to cancel, you must inform us of your decision to cancel the order by a clear statement (e.g. a letter sent by post to the above address or email to us at info@palawan.co.uk)
7.5 How we will notify you. Once we receive your notice of your intention to cancel we will send you a cancellation notification for your records. Your cancellation will be effective from the date you notified us.
7.6 Returning Books to us. The Books must be returned directly to us unused, within 14 days of the date of your notice to cancel and we are responsible for issuing all refunds in relation to cancelled orders and returned Books (excluding delivery charges, gift wrapping and other additional expenses). We have the right to withhold or reduce any refund on Books that have been damaged or otherwise diminished in value.
7.7 Responsibility for the cost of return. We do not offer free returns, so you will be responsible for paying the cost of postage if you choose to return Books to us. Each of our Books is custom packaged, and therefore we must ask you to use the same packaging when returning Books to us. We will only pay the costs of return if the Books are faulty or mis-described.
7.8 How we will refund you. Please note that we will not make any refund to you until we have received the relevant Books from you and confirmed that they have not been damaged. We will then credit you with the cost of the unwanted Books within 30 days of the date of your cancellation.
8. OUR WARRANTY AND LIABILITY
8.1 We warrant to you that Books purchased from us through our Website will be of satisfactory quality and reasonably fit for all the purposes for which such Books are commonly supplied.
8.2 Our liability for any losses that you might suffer as a result of you placing an order for Books is strictly limited to the purchase price of the Books that you have purchased. We exclude all liability and responsibility to you for all other loss or damage that you might suffer provided that this exclusion does not include or limit our liability for (i) death or personal injury caused by our negligence (ii) fraud or fraudulent misrepresentation or (iii) any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
8.3 Our employees and agents are not authorised to make any representations or give any warranty concerning the Books unless these are confirmed in writing by us. In placing your order you acknowledge that you do not rely on and waive any claim for any breach of any representation or warranty which is not so confirmed.
9. FORCE MAJEURE
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations hereunder that is caused by Force Majeure. “Force Majeure” means any act or event beyond our reasonable control, including without limitation strikes, lockouts or other industrial action, civil commotion, riot, terrorist attack (or threat), war (or threat) or fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
10. OTHER TERMS
10.1 “Writing” includes emails. When we use the words “writing” or “written” in these Terms, this includes emails.
10.2 These Terms are governed by English law and the courts of England and Wales will have nonexclusive jurisdiction over such disputes and claims.
